Expertise and Experience

Brooke has over 10 years legal experience working primarily in property law. Her areas of speciality include property development, retail and commercial leasing, business sales and acquisitions, commercial land and building sales and acquisitions.

Professional Interests

Over the years, Brooke has acted for many different developers and has been actively involved in property developments from site acquisition right through to end sales.This development experience includes structuring advice and document preparation (including off the plan contracts) in residential, commercial and mixed use developments, liaising with consultants such as surveyors and builders, meeting financier requirements for pre-sale funding, negotiating Infrastructure Agreements with Council and co-ordinating and assisting with the establishment of bodies corporate.

Brooke also advises buyers in relation to off the plan contracts. Recently, Brooke was involved with litigation concerning material prejudice to buyers under the Body Corporate and Community Management Act and was successful in having the Court hold that a buyer has successfully terminated their off the plan contract.

Brooke is experienced in providing advice in relation to a broad range of legislation including the Body Corporate and Community Management Act, the Property Agents and Motor Dealers Act and the Land Sales Act and is experienced in the negotiation and preparation of joint venture agreements, share sale agreements, shareholder agreements, unit holder agreements, and put and call option agreements.
